This contribution focuses on legal issues raised by the audiovisual broadcasting of performing arts, which has significantly increased due to the SARS-CoV-2 pandemic. First, we contextualize this practice and briefly present the emergence and evolution of the practice of “filmed theater”, as well as any other form of performances (e.g., concert, ballet, opera) originally conceived for the stage but subsequently diffused through other channels. Secondly, we address the current legal issues that have arisen because of the increase of such (...) practice due to the containment measures taken by government. Two axes are of particular attention: the matter of copyrights and related rights, on the one hand, and the question of public financing, on the other. Concerning intellectual property, audiovisual broadcasting leads to several legal consequences and issues: effectiveness of related rights, emergence of new modes of exploitation and new authors, recognition of the recording as an original work, etc. This new practice is, moreover, likely to disrupt the categories established by public funding legal mechanisms, which are often poorly adapted to hybrid artistic objects. The objective of this part is therefore to analyze the new legal issues raised by the audiovisual distribution of performances. Finally, we go beyond exclusively legal issues to examine the very specificities of performing arts and, more specifically, the possible loss that would result from a fixation of a production on a reproducible medium, making its diffusion possible beyond the stage. A pesar de que son numerosas las interpretaciones que, a veces con inusitada violencia, se han hecho de la filosofía de Friedrich Nietzsche, no se ha prestado siempre la debida atención a uno de los aspectos más importantes de su obra y sin el cual ésta perdería toda la tensión creativa que le es propia: la reflexión radical sobre el arte. Nietzsche se funda en la convicción de que el «arte y nada más que el arte» no sólo es un (...) «estímulo para la vida», sino también aquello que puede enseñar a vivirla y a que sea posible y soportable. This volume has 41 chapters written to honor the 100th birthday of Mario Bunge. It celebrates the work of this influential Argentine/Canadian physicist and philosopher. In "Off Track" art and philosophy are the inspiration to look differently at daily life and organizations. The book is a plea to approach the complexity of the current world with new metaphors. The author calls this "hinking around". She sees that in "square worlds" there is a need for tools to approach entrenched patterns and systems differently and to get thought processes moving. Sarai van de Boel challenges the reader to look at one's own systems from the inside with (...) a philosophical approach. In eight chapters there are eight "tracks" to follow, but it is also possible to go off the rails. More than fifty works of art by well-known and lesser-known artists and designers play a role in these traces. Our think tank tasked by the Dutch Health Council, consisting of Radboud University Nijmegen Honours Academy students with various backgrounds, investigated the implications of Deep Brain Stimulation for psychiatric patients. During this investigation, a number of methodological, ethical and societal difficulties were identified. We consider these difficulties to be a reflection of a still fragmented field of research that can be overcome with improved organization and communication. To this effect, we suggest that it would be useful to found a centralized (...) DBS organization. Such an organization makes it possible to 1) set up and maintain a repository, 2) facilitate DBS studies with a larger sample size, 3) improve communication amongst researchers, clinicians and ethical committees, and 4) improve communication between DBS experts and the public at large. Le philosophe populaire berlinois Johann Jakob Engel a amorcé, à la fin du XVIII siècle, des recherches importantes dans le domaine de la sémiotique esthétique, problématique alors presque entièrement neuve que venait de lancer le Laocoon de Lessing. A peine quelque années plus tard, l’œuvre de Engel constitue déjà un élargissement considérable de la problématique lessingienne, tout autant d’ailleurs qu’une remise en cause de certaines de ses prémisses : la sémiotique théâtrale ne peut-elle constituer une alternative à la (...) scission sémiotique des « arts du temps » et des « arts de l’espace » ? Plus spécifiquement, l’analyse sémiotique du geste sera pour Engel l’occasion de dégager deux notions singulièrement opératoires : « peinture » et « expression » (Malerei, Ausdruck) qui seront transposables dans une sémiotique esthétique générale. En effet, elles permettent à Engel est de dégager analogies fortes entre musique, poétique, gestuel, pour s’acheminer vers une sémiotique comparée dont la perspective est entièrement neuve. On en retracera les ressorts essentiels en mettant en lumière le rôle intermédiaire important dévolu d’une part au modèle rhétorique de l’éloquence, d’autre part à la fonction métaphorique – moteurs de la transposition d’une sémiotique du langage à celle d’un « langage du geste ». PurposeTo explore the mindfulness practice, its long-term effects, facilitators and barriers, in clinical clerkship students 2 years after participation in an 8-week mindfulness-based stress reduction training.MethodA qualitative study was performed by semi-structured in-depth interviews with 16 clinical clerkship students selected by purposive sampling. Students had participated in a MBSR training 2 years before and were asked about their current mindfulness practice, and the long-term effects of the MBSR training. Thematic analysis was conducted using the constant comparison method. Data saturation was (...) reached after 16 interviews.ResultsMost interviewees were still engaged in regular, predominantly informal, mindfulness practice, although some discontinued mindfulness practice and reported an “unchanged lifestyle.” Three main themes came forward; “focused attention and open awareness” during daily activities as core elements of long-term mindfulness practice; “changes in behavior and coping” that resulted from taking a pause, reflecting, recognizing automatic behavioral patterns and making space for a conscious response; “integration in personal and professional life” by enhanced enjoyment of daily activities, improved work-life-balance and making different career choices. Barriers and facilitators in starting and maintaining mindfulness practice were understanding and intention as “pre-conditions”; practical, personal, and professional factors of students in maintaining practice.ConclusionTwo years after participation in a MBSR training, many interviewees were still engaged in mindfulness practice contributing to both personal and professional changes. In light of the high clerkship demands, MBSR training could be a valuable addition to medical curricula, supporting medical students in developing necessary competencies to become well-balanced professionals. Quando assisti pela primeira vez a “Sociedade dos Poetas Mortos”, em 1989 (ano de lançamento no cinema), a história protagonizada pelo saudoso Robin Williams me comoveu profundamente. Naquela época eu caminhava rumo aos meus 20 anos, quando a vida ainda parece uma areia movediça e o futuro, uma eternidade. Eu ainda estava na Faculdade de Filosofia da UFBA, em Salvador, preparando-me para ser professor.

There is a growing recognition that philosophy isn’t unique to the West, that it didn’t begin only with the classical Greeks, and that Greek philosophy was influenced by Near Eastern traditions. Yet even today there is a widespread assumption that what came before the Greeks was "before philosophy." In Philosophy before the Greeks, Marc Van De Mieroop, an acclaimed historian of the ancient Near East, presents a groundbreaking argument that, for three millennia before the Greeks, one Near Eastern people had (...) a rich and sophisticated tradition of philosophy fully worthy of the name. In the first century BC, the Greek historian Diodorus of Sicily praised the Babylonians for their devotion to philosophy. Showing the justice of Diodorus’s comment, this is the first book to argue that there were Babylonian philosophers and that they studied knowledge systematically using a coherent system of logic rooted in the practices of cuneiform script. Van De Mieroop uncovers Babylonian approaches to knowledge in three areas: the study of language, which in its analysis of the written word formed the basis of all logic; the art of divination, which interpreted communications between gods and humans; and the rules of law, which confirmed that royal justice was founded on truth. The result is an innovative intellectual history of the ancient Near Eastern world during the many centuries in which Babylonian philosophers inspired scholars throughout the region—until the first millennium BC, when the breakdown of this cosmopolitan system enabled others, including the Greeks, to develop alternative methods of philosophical reasoning. The critical concern of the present volume is contemporary naturalism, both in its scientific version and as represented by newly emerging hopes for another, philosophically more liberal, naturalism.1 The papers collected here are state-of-the-art discussions that question the appeal, rational motivations, and presuppositions of scientific naturalism across a broad range of philosophical topics. As an alternative to scientific naturalism, we offer the outlines of a new non- reductive form of naturalism and a more inclusive conception of nature than any provided (...) by the natural sciences. Our authors collectively believe that holding scientific naturalism up for philosophical scrutiny and challenging its misconceptions is of the first importance both for understanding ourselves and our place in the world; and, also, for the future direction of philosophy itself. This paper intends to show how Schopenhauer‟s „eristic dialectics‟, defined by him as „the art of being right‟, arise from the combination of two lines of thought on dialectics: the Aristotelian tradition, in which dialects are understood as an argumentative discourse based on generally accepted notions; and the tradition set in motion by Kant, which understands dialectics as a logic of appearances or of illusion. The interpretation we favor, and which we intend to argue in this work, is the following: (...) while attempting to assimilate and to go beyond the teachings of both traditions, Schopenhauer sets forth the basic elements of a kind of communicative rationality in which the polemical functioning of language, understood as the effective instrument of a certain „will of power‟, becomes the sole factor which determines the consolidation of social beliefs and values. Em 2022 teremos uma celebração muito especial para a Música Popular Brasileira. O icônico disco “Clube da Esquina”, de Milton Nascimento e Lô Borges, completará 50 anos de lançado. O álbum apresentou ao mundo mais do que o resultado de uma parceria musical de rara beleza; ele foi uma espécie de marco zero de um movimento artístico e existencial nascido na bucólica Belo Horizonte da segunda metade da década de 1960, envolvendo amigos, música, cinema e literatura.

Ainda que possa ser visto como clichê sob diversos aspectos, o filme “O Céu da Meia-Noite” (dirigido e protagonizado por George Clooney para a Netflix) traz temas reflexivos na perspectiva existencial. Lançado em dezembro de um ano doloroso para a humanidade, ele teve as suas gravações encerradas pouco antes do início da pandemia, ainda que traga uma atmosfera tão soturna quanto a deste momento histórico.

O início da terceira década do século 21, tão marcado pela globalização tecnológica e virtualização das relações humanas, ainda mantém fortes laços com o obscurantismo religioso da Idade Média. Com outra roupagem, o fanatismo de muitos cristãos das mais variadas igrejas eterniza sentimentos e ações que acreditávamos superados há séculos. A intolerância religiosa, normalmente carregada de outras tantas intolerâncias na pauta moral, revela com clareza que a caça às bruxas nos tempos da chamada Santa Inquisição foi atualizada com sucesso. O (...) Brasil, por exemplo, vive um de seus piores momentos históricos neste sentido, principalmente pelos recorrentes ataques furiosos às religiões de matriz africana e crimes de agressão e morte contra as chamadas minorias sociais. Revendo recentemente o ótimo filme “A Vila”, do diretor indiano M. Night Shyamalan (o mesmo diretor de “O Sexto Sentido”, “Corpo Fechado” e “Sinais”), é possível entender os motivos que levaram os fundadores do vilarejo fictício a criar um mundo à parte para as futuras gerações. O filme, de 2004, é inserido no gênero “suspense” por conta de sua história central em torno de uma lenda sobre criaturas aterradoras que vivem na floresta. Estas são o empecilho para que os moradores (...) cultivem o desejo de deixar o único lugar que conhecem. (shrink)

Desde que foram criados pelos sumérios há mais de 5 mil anos, os livros sempre aterrorizaram os ocupantes do topo de quaisquer formas de poder. Neles estiveram e continuam sendo guardados os sonhos, as ideias, os projetos e as ações da humanidade em todas as vertentes possíveis, sejam eles libertadores e instigantes para as transformações positivas do mundo e do próprio ser humano, sejam eles os caminhos opostos da destruição e da opressão. [...].

“Não existe ninguém que não esteja mais próximo da morte depois de um ano que antes dele, amanhã mais do que hoje, hoje mais do que ontem, pouco depois mais do que agora e agora pouco mais do que antes”. Neste trecho do livro “Cidade de Deus”, um dos mais importantes filósofos da Idade Média – Santo Agostinho (354-430) – enfatiza uma velha constatação da humanidade, mas que a angustia em qualquer época.

À la manière de Sartre, qui renonce à la question de l'essence de la littérature et lui préfère celle de son utilité, Deleuze interroge, non l'essence de l'art, mais son usage pour le philosophe. Selon Deleuze, l'art est nécessaire au philosophe pour penser sa propre condition. En effet, pour échapper à la représentation qui dénature et assujettit la pensée, la philosophie exige un détour par l'art qui transforme à la fois l'exercice de la pensée et les conditions de l'expérience. L'usage (...) de l'art, c'est ce que fait l'art. L'art capte des forces (il rend visibles des forces invisibles) et transforme, à la fois, l'artiste et le corps social (il bouleverse les manières de sentir et de penser). Cette nouvelle manière de penser et d'user de l'art déborde le cadre habituel des études esthétiques. Il s'agit ici d'établir une périodisation de la question de l'art dans l'oeuvre de Deleuze, en fonction des problèmes qu'il pose. On retiendra trois périodes qui sont trois philosophies de l'art : la première accorde la priorité à la littérature ; la deuxième opère le passage du littéraire au sémiotique, en mettant en lumière le rôle politique de l'art ; et la troisième élabore une sémiotique de l'image, à partir de la peinture et du cinéma. Este artículo trata sobre cómo la imagen de la mujer en la pintura tradicional presenta un código de conducta y una realidad histórica. La mujer desnuda, en cuyo retrato tiene más importancia el cuerpo que la cabeza, la mujer pintada ofrecida como un paisaje, una comida o una presa, dificultará una relación de comunicación entre los sexos y encerrará a la mujer en un arquetipo denigrante. Por eso la primera respuesta de las mujeres pintoras ha sido siempre la búsqueda de (...) su propia imagen en el autorretrato. Actualmente las mujeres artistas buscan nuevos símbolos con qué definir su identidad en oposición a los símbolos clásicos de la tradición pictórica. (shrink)

Pourquoi certaines injustices conduisent-elles à des révoltes quand d'autres sont subies passivement? Comment expliquer que la contestation s'empare d'une partie du corps social sans que personne n'ait pu l'anticiper? Qu'est-ce qui maintient le peuple tranquille ou, au contraire, le met en mouvement? Après "Nuit debout" et les manifestations sociales qui ont émaillé 2016, ces questions prennent un relief particulier. Pour Frédéric Lordon, ce ne sont pas les "idées" qui mettent les individus en mouvement, mais les affects. Même lorsqu'un groupe étaie (...) sa révolte sur une théorie, cette théorie puise son énergie à la source de passions comme l'indignation, la crainte ou l'espérance. En s'appuyant sur la théorie des affects de Spinoza, Frédéric Lordon propose une interprétation tout à fait originale de l'idéologie (qui installe les peuples dans la servitude volontaire) et de la contestation (où l'équilibre affectif est rompu, rendant intolérable ce qui était jusque-là toléré). Car la politique est un art d'affecter. "Ce que je m'apprête à faire, cette décision que je vais prendre, qu'est-ce que ça va leur faire?", voici la question au principe de toute pratique politique : persuader, convaincre, c'est affecter. En s'appuyant sur des situations politiques récentes et connues, ce livre analyse quelques-uns des procédés de cet art, non sans montrer tout ce qui le grève d'aléas... et de possibles ratages. Car les hommes politiques, sociologiquement séparés de la population, n'ont qu'une connaissance lacunaire des complexions passionnelles de ceux à qui ils s'adressent et, en réalité, ignorent presque tout de ce qui "leur fait quelque chose". Ce livre stimulant déploie une théorie concrète des affects politiques et montre que c'est par un usage des passions, autant que par un exercice de la raison, que l'on a une chance de transformer ce monde. Este trabalho pretende comentar a doutrina que Merleau-Ponty expõe, em seus distintos períodos, sobre o que caracteriza a obra clássica e sua interpretação. Aponta-se como pressupostos dessa doutrina a admissão de uma certa filosofia da linguagem, bem como de uma particular teoria da produtividade. Em função disso, pergunta-se se, efetivamente, foi feita, ali, uma crítica radical da "filosofia da consciência", como usualmente se supõe.  .
